Health Care Fraud

From doctors to medical technicians to hosptial administrators, today’s health care professionals know that the industry is governed by detailed and complicated regulations and laws.  Health care has become a highly scrutinized and heavily regulated business.  State and federal regulators routinely review the billing and practice records of medical groups and individual doctors.  Far too often these everyday audits can become full blown grand jury investigations which can lead to formal criminal charges which carry shockingly long potential prison sentences.  False claims actions in both federal and state courts can lead to massive fines.

Charles A. Ross & Associates has vast experience in representing health care professionals in a variety of forums.  We have represented numerous individual doctors, medical practice groups, pharmaceutical companies and executives, hospitals and hospital administrators, a national laboratory, home health agencies, and durable equipment manufacturers, as well as many individuals in responding to government investigations, subpoenas, document requests, grand jury investigations, and in trials and negotiated dispositions of civil and criminal charges.

Our representation includes a rigorous attention to the detail of facts and law, the use of industry experts, and sophisticated advocacy before administrative panels, prosecutors, judges and juries.  We understand this complicated area and appreciate that our health care industry clients depend upon their licenses for their livelihood.

Chuck Ross interviewed by National Law Journal on “off-label” marketing of drugs

“‘I definitely think there are instances where the pharmaceutical industry is being unfairly targeted [for off-label prescriptions],’ said Charles Ross of New York’s Charles Ross & Associates, who has defended several individuals in off-labeling investigations in recent years. ‘On the one hand, doctors are permitted to write prescriptions for off-label medications, but on the other hand there are very restrictive approaches that pharmaceutical companies can take to let doctors know that there are off-label uses that are beneficial,’ Ross said.”
