“A study of 1,515 post-Booker sentences from Jan. 1, 2006 through Nov. 16, 2006 by the New York Council of Defense Lawyers found that the courts of appeals have affirmed nearly all within-guidelines sentences, while reversing nearly all below-guidelines sentences. ‘The statistics are really amazing,’ said Charles A. Ross, a veteran criminal defense attorney in New York. ‘As a defense lawyer, I think a message needs to be sent to the circuit courts that you review on the Booker standard, which is reasonableness, and not a guidelines sentence as presumptively reasonable,’ he said.”
